(hereinafter referred to as the “Seller”)

 

 

I. Introductory Provisions

The Seller operates the online store available at www.everose.shop (hereinafter referred to as the “Website”).

For the purposes of these General Terms and Conditions, Goods shall mean in particular fresh cut flowers, flower bouquets, preserved roses (e.g., Everose), gift boxes and other products offered on the Website (hereinafter referred to as the “Goods”).

The purchase price is the price displayed for the Goods on the Website at the time of placing the order. All prices are stated including VAT.

Images of Goods on the Website are illustrative. Due to seasonal availability, the final appearance of bouquets may slightly differ; however, the overall value, color scheme and number of flowers will be maintained.

These General Terms and Conditions form an integral part of the Purchase Agreement concluded between the Seller and the Customer.

 

 

II. Conclusion of the Purchase Agreement

An order placed by the Customer through the Website constitutes a proposal to conclude a Purchase Agreement.

The Customer is obliged to provide accurate and complete information.

The Seller confirms receipt of the order via email. The Purchase Agreement is concluded upon delivery of the order confirmation to the Customer.

The Seller reserves the right to cancel an order in the event of:

  • unavailability of Goods,
  • force majeure,
  • incorrect or false customer information.

If payment has already been made, the amount will be refunded within 14 days.

The Customer may modify or cancel the order no later than 24 hours before the scheduled delivery.

 

 

III. Payment Terms

The Customer is obliged to pay the purchase price properly and on time.

Available payment methods:

  • Online card payment
  • Bank transfer
  • PayPal
  • Cash upon personal collection (if available)

If an incorrect price is displayed due to a technical error, the Seller reserves the right to cancel the order.

Ownership of the Goods passes to the Customer only after full payment of the purchase price.

 

 

IV. Delivery of Goods

The Seller delivers the Goods via courier service or allows personal collection.

The delivery fee is €6 including VAT unless stated otherwise.

Delivery is available within the Slovak Republic.

The Goods are considered delivered when accepted by the Customer or an authorized person.

If the Customer unjustifiably refuses to accept the Goods, they are considered delivered.

Damage During Transport

The Seller bears full responsibility for any damage to the Goods occurring during transportation.

The Customer is required to inspect the shipment immediately upon delivery. In the event of visible damage to the packaging or the Goods, the Customer must notify the courier and inform the Seller without undue delay.

If transport damage is confirmed, the Seller will, at its own expense:

  • replace the damaged Goods, or
  • refund the full purchase price.

All costs related to damage caused during transportation are fully covered by the Seller.

 

 

V. Rights and Obligations

The Seller is obliged to:

  • deliver the Goods in the agreed quantity and quality,
  • comply with applicable laws of the Slovak Republic.

The Customer is obliged to:

  • accept the Goods,
  • pay the purchase price,
  • inspect the Goods upon receipt.

 

 

VI. Withdrawal from the Contract

In accordance with applicable Slovak and EU consumer protection laws, a consumer has the right to withdraw from the contract within 14 days without giving any reason.

However, withdrawal is not possible in the case of:

  • Goods made to order or personalized products,
  • perishable Goods subject to rapid deterioration (including fresh flowers).

The Customer bears the cost of returning Goods unless otherwise agreed.

 

 

VII. Alternative Dispute Resolution

The Customer has the right to contact an alternative dispute resolution body in accordance with Act No. 391/2015 Coll.

VIII. Final Provisions

These General Terms and Conditions enter into force on the date of their publication on the Website.

The Seller reserves the right to amend these Terms and Conditions at any time.

Legal relations not regulated herein shall be governed by the applicable laws of the Slovak Republic.
